SoundExchange collects and allocates digital performance royalties (Sirius XM, satellite radio) for over half a million creators. We at Mogul help thousands of artists and their teams to register their works with SoundExchange to claim these royalties.
If you happen to have run into a dispute as a result of using the Mogul Registration Tool, we’ve put together this handy guide as to what this means and what your options are for resolving.
What does this mean, and what should I do?
When a new entity comes in and claims a track and it creates an overlap or dispute the old or original claimant has 30 days to respond. If they do nothing the original claim falls off and the new claimant starts to receive the royalties moving forward.
So if you just claimed a track and it created an overlap or dispute you should ask yourself if the originally claiming party should continue claiming the royalty stream and you should fall off of it, or if you should maintain and stick with your submission.
How do I resolve these issues?
Until recently, you could only resolve one recording at a time. However, SX has just introduced a new enhancement: Bulk Resolution. This lets artists and rights holders resolve multiple sound recordings simultaneously, in real-time.
Here’s the actions you should take:
Resolving Claims
Step 1: Log into your SXDirect account – https://sxdirect.soundexchange.com/login/
Select My Catalog → Overlaps and Disputes
If you have any overlaps or disputes, they’ll show up here
Step 2: Decide which category you want to resolve: Recordings in Overlaps, Recordings in Dispute, or overlaps which are Expiring Soon (this is for if you have any potential funds leaving your account).
Step 3: Once you decide on a category, there’ll be a blue box in the top right corner letting you Start Bulk Selection.
Step 4: Once you press it, you’ll be prompted to choose from the following options:
Maintain
Relinquish
Accept/Reject Date Proposals
Remove Claim.
Step 5: After choosing Maintain, the recordings you selected will be isolated in one page. Check the corresponding boxes to the left of the Artist column to add the tracks you want to maintain to your cart.
You can either select tracks in Confirm status (where you’re the existing claimant), or Reconfirm status (where you’re the new claimant and action is needed).
Click on Review Selections in the lower right corner once you have chosen your tracks.
Step 6: On the Review page, there’s multiple actions you can take before submitting your final list:
To add any other recordings, click Select Recordings
Click X to remove any tracks
Click Details to get more information on a specific track
Once you’re ready, click Submit Selections
Relinquishing Claims
Step 1: As before, select Start Bulk Selection, but this time click Relinquish
After selecting Relinquish, choose whether you're giving up a claim as the existing or new claimant.
Everything is the same as in Maintain, select Relinquish Details to advance.
Step 2: On the Relinquish page, first, choose how you're withdrawing your rights:
For all time? Select No and click Review to proceed as you did when maintaining claims.
As of a specific date? Select Yes and enter the date.
Then, decide if you should still be paid for airplay during your ownership period:
Yes: Enter the date range.
No: Enter the date or select Today to stop future payments.
New claimants must confirm the date proposals before the process is finalized. Click Review to continue following the same steps you took for Maintain.
Accept/Reject Proposals
Using this feature, you can accept or reject changes to when you start getting credit for a recording (in bulk).
Step 1: Go to the Summary screen, click Start Bulk Selection, and choose Accept or Reject Date Proposals.
You'll see a modified Select page with a Proposed Date field showing when your ownership would begin.
Step 2: Check the tracks you want to accept or reject.
Step 3: Click Review Selections, confirm the details, then click Submit Selections to finalize.
Remove Claim Feature
This is available for new claimants who want to remove a claim before it hits Reconfirm status.
If you realize that you submitted an incorrect claim for a recording and want to undo it, this is where this feature is helpful
Simply Select Remove Claim, confirming the royalties should continue to flow through the original claimant.
